A man was sentenced today (May 10) to eight years and four months in prison for conspiring with a foreign online drug supplier to traffic in counterfeit prescription drugs and selling unlicensed drugs, a federal judge has heard.
In the United States, counterfeit drugs are illegal in the United Kingdom, Canada, Australia and Canada, but counterfeit drug companies are allowed to sell unlicensed drugs at a lower price than what consumers can buy from a legitimate supplier.
“The FDA, and the Canadian government have a responsibility to the public to be vigilant and responsible in protecting consumers,” the judge wrote in sentencing, adding that the FDA’s role is limited to monitoring and assessing drug makers’ drug-distribution activities.
In a sentencing statement, the FDA said the product seized from the alleged co-conspirator, Dr. Mark B. Hofer, had the potential to be counterfeit. The FDA said it reviewed the drug samples submitted to it and determined that the active ingredient in the drugs, Viagra, was not as active as the active ingredient in the counterfeit drugs.
The company, known as Dr. John D. Runde, admitted he knew of the counterfeit drugs that were seized from Hofer, which are sold in the United States and Canada and sold by online retailers. The FDA says it has not determined how many doses of the drugs were sold.
Runde sold about 25 of the products and more than 100,000 prescriptions from the counterfeiters, including about 5,000 Viagra pills.
